Abuja – A Court of Appeal presided by Justice Stephen Adah has issued an order staying the execution of earlier order by a lower court barring INEC from recognizing candidate of the All Progressive Congress in Saturday’s governorship poll in Bayelsa State.
Recall the two courts of coordinate jurisdiction in Abuja and Bayelsa had disqualified deputy governorship candidate of the APC, invalidating the party’s nomination for the election
With the subsisting order, the confusion that pervaded last night during a lengthy meeting of the Independent National Electoral Commission ( INEC)last night to decide on the Bayelsa poll has been cleared.
In the ruling obtained by D.D Dodo, SAN, Principal Counsel of the ruling party in Abuja on Thursday, the appellate court panel held that the status quo Bellum be maintained pending the hearing of the substantive matter.
“The Appeal Court granted and made the following orders:
That the status quo ante Bellum which existed on or before the 19th September, 2019 when the suit was filed be maintained pending the hearing and determination of the Motion on Notice.
“An interim order for stay of the judgment of the lower court delivered on 12th November 2019 pending the hearing and determination of the Motion on Notice.
“The Motion on Notice to be heard on 20th November 2019 and the Respondents to be served with the Motion on Notice and copy of the Court Order”.

With this development the APC Deputy Governorship candidate, Sen. Biobarakuma Degi-Eremienyo is now cleared for the November 16 election.
Meanwhile, even as the court order was in the incubation, the election umpire, INEC emerged from its meeting ahead of the November poll declaring that the two elections in Kogi and Bayelsa would proceed as planned.
